Terms of Service

These Terms of Service (the “Terms”) constitute a binding legal agreement between you (“User,” “you,” or “your”) and DialectX LLC (“DialectX,” “Company,” “we,” “us,” or “our”) governing your access to and use of the DialectX responsive web application, website, APIs, and any related services (collectively, the “Service”). The Service is delivered exclusively through modern web browsers; there is no native mobile application, App Store, or Google Play distribution. By accessing, registering for, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must not access or use the Service.

DialectX is an automated, machine-generated translation tool. You expressly acknowledge and agree that any use of the Service is undertaken entirely at your own risk, discretion, and responsibility. Automated translations may contain inaccuracies, omissions, mistranslations, contextual errors, or dialect-specific deviations. The Service is not a substitute for a certified human translator, professional legal counsel, medical advice, or any other licensed professional service. You are solely responsible for reviewing, verifying, and validating any translation output before relying upon it for any purpose, including but not limited to legal, medical, financial, educational, governmental, or commercial use.

THE SERVICE IS PROVIDED ON A STRICTLY “AS-IS” AND “AS-AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

To the fullest extent permitted by applicable law, DialectX LLC, its owners, officers, directors, employees, contractors, affiliates, licensors, and operators (collectively, the “Released Parties”) shall not be held liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:

• financial losses, lost profits, lost revenue, or lost business opportunities;
• legal damages, regulatory penalties, or settlement costs;
• business interruption, downtime, or operational disruption;
• reputational harm or loss of goodwill;
• damages arising from translation inaccuracies or omissions;
• damages arising from system downtime, outages, or unavailability;
• damages arising from software errors, bugs, vulnerabilities, or defects.

This limitation applies regardless of the legal theory asserted (contract, tort, strict liability, or otherwise) and even if the Released Parties have been advised of the possibility of such damages.

By accessing or using the Service, you expressly and irrevocably waive any and all rights to pursue legal action, lawsuits, arbitration claims, administrative complaints, or class action claims against DialectX LLC, its owners, operators, officers, employees, contractors, affiliates, and any related parties arising out of or relating to the Service, these Terms, or any translation output. Any such claim, demand, or cause of action that you may otherwise have is hereby rendered null, void, and unenforceable to the maximum extent permitted by applicable law. You further waive any right to participate as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

All purchases, subscriptions, renewals, upgrades, downgrades, free trials, and any text, documents, audio, images, or information you enter, upload, or transmit through the Service are made and submitted at your sole risk and discretion. All subscription billing, upgrades, cancellations, and refund processing are handled exclusively on our web platform through our payment processor, Stripe, including the Stripe Customer Portal accessible from your Account page. Apple App Store and Google Play in-app purchase systems are not used. Subscription fees are billed in advance and are non-refundable except where required by applicable law or expressly permitted under our Refund Policy. You are solely responsible for determining whether the Service is appropriate for your intended use and for any data you choose to submit.

Pro-exclusive premium voice controls. The Male / Female voice gender toggle is an exclusive DialectX Pro feature. Guest and Starter accounts hear a fixed, high-quality standard voice per language and dialect; only active Pro subscribers may manually switch the voice gender for translations, dictionary playback, and source-language audio.

You agree not to submit any content that you are not legally entitled to share, that contains sensitive personal information of third parties without their consent, or that violates any applicable law or third-party right.

You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the Service; (b) use the Service to generate unlawful, defamatory, harassing, fraudulent, or infringing content; (c) interfere with or circumvent any security, rate-limiting, or quota mechanism; (d) resell, sublicense, or commercially redistribute the Service without our prior written consent; or (e) use the Service in any manner that could damage, disable, or impair the Service or interfere with any other party’s use of it.

The Service, including all software, design, branding, and content provided by DialectX, is owned by DialectX LLC and is protected by intellectual property laws. You retain ownership of the content you submit, but you grant DialectX a limited, worldwide, royalty-free license to process, transmit, and display that content solely as necessary to provide the Service to you.

DialectX LLC reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without notice. We may also update these Terms from time to time. Continued use of the Service following any modification constitutes your acceptance of the revised Terms.

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including for any violation of these Terms. Upon termination, all rights granted to you hereunder will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DialectX LLC is organized, without regard to its conflict-of-law provisions. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
